Initiative Rules

NO PURCHASE OR PAYMENT IS NECESSARY

  1. Eligibility: This initiative (“Initiative”) is open only to legal residents of the fifty (50) United States (and the District of Columbia) and Canada who are eighteen (18) years of age or older who are new subscribers to Sega’s eNewsletter at the time of sign up. Void where prohibited. Employees of Sega of America, Inc. (“Sega”) and Sky Castle Studios, LLC (“Hero Forge”) and their respective parents, affiliates, subsidiaries, distributors, sales representatives, and all other service agencies involved with the Initiative and members of their immediate family (spouse, parents, siblings, and children) and household members (whether related or not) of each such employee are not eligible. To receive the incentive stated on the sign-up page, you must fully comply with the Initiative Rules and must be one of the first 3,000 from the Initiative to sign up for Sega’s eNewsletter. By signing up for the eNewsletter, you represent and warrant that you agree to be bound by these Initiative Rules and the decisions of Sega, whose decisions shall be binding and final in all respects relating to this Initiative.

  2. Timing: The Initiative begins on February 15, 2024, at 9:00AM PT and ends on the date listed on the sign-up page (“Initiative Period”). The Initiative is governed by these Initiative Rules and is subject to all applicable federal, state and local laws.

  3. How To Participate: During the Initiative Period, go to https://unicornoverlord.atlus.com/newsletter/index.html and register for the eNewsletter by following the instructions to complete and successfully submit the request. Only available to new signups. Individuals who are already subscribed to Sega's eNewsletter who unsubscribe then re-subscribe again to receive incentive will not be eligible. When you complete the website entry form, you will automatically be registered for the Initiative. Limit of one (1) incentive per person. Multiple subscribers are not permitted to share the same email address. Any attempt by any subscriber to obtain more than the stated number of registrations by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that subscriber’s entries and that subscriber may be disqualified. Use of any automated system to participate in the Initiative is prohibited and will result in disqualification. Sega is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified.

  4. Recipient Notification: If you are eligible to receive the incentive, you will be emailed one (1) code after the Initiative Period that can be redeemed for any one (1) Color Standee valued at USD $12.99 by Hero Forge (see examples of products at https://www.heroforge.com/products/color-standee/). Code is not valid for XL Color Standee, or any other products listed on Hero Forge website. Shipping and handling charges shall apply and vary by region. Enter your code at checkout and the code will be automatically applied to your order. Once you complete the foregoing, Hero Forge shall fulfill your order by delivering it to your provided mailing address. The mailing address you provide must be in the United States or Canada. No PO Boxes accepted. Sega and Hero Forge are not responsible for lost or misdirected items that are sent. Sega is not responsible for processing, shipping or handling orders and all inquiries regarding orders must be directed to Hero Forge at support@heroforge.com. Orders not eligible for return.   5. Entry Conditions and Release: Each subscriber agrees to: (a) comply with and be bound by these Initiative Rules and the decisions of Sega which are binding and final in all matters relating to this Initiative; and (b) defend, indemnify, release and hold harmless the Sega, Hero Forge and their respective parent, subsidiary, and affiliated companies, and any other person and third party responsible for sponsoring, fulfilling, administering, advertising or promoting the Initiative, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a subscriber’s entry, creation of an entry or submission of an entry, participation in the Initiative, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of the incentive (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry. Subscriber acknowledges that the incentive is provided as-is without warranty of any kind.

  6. General Conditions: Sega and its subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors shall not have any obligation or responsibility, including any responsibility to award any incentive to subscribers, with regard to: (a) entries that contain inaccurate information or do not comply with or violate the Initiative Rules; (b) entries, incentive claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) subscribers who have committed fraud or deception in entering or participating in the Initiative or claiming the incentive; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the subscriber to accept the incentive for any reason; (f) if an incentive cannot be provided due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Sega or Hero Forge reasonable control; or (g) any damages, injuries or losses of any kind caused by any incentive or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any incentive or resulting from participating in this Initiative or any promotion or incentive related activities. Sega reserves the right, in its sole discretion, to disqualify any individual it finds to be (x) tampering with the entry process or the operation of the Initiative, or with any website promoting the Initiative; (y) acting in violation of the Initiative Rules; or (z) signing up or attempting to sign up for the Initiative multiple times through the use of multiple email addresses or the use of any robotic or automated devices to submit entries. If Sega determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Initiative, Sega reserves the right to void the entries at issue, and/or terminate the relevant portion of the Initiative, including the entire Initiative, and/or modify the Initiative and/or award the prize from all eligible entries received as of the termination date.

  7. Limitations of Liability: The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by subscribers, printing errors or by any of the equipment or programming associated with or utilized in the Initiative; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Initiative; (d) technical or human error in the administration of the Initiative or the processing of registrations; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from subscriber’s participation in the Initiative or receipt or use or misuse of any prize. If for any reason a subscriber’s registration is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, subscriber’s sole remedy is to be reentered into the Initiative.

  8. Disputes: Except where prohibited, by participating, subscribers agree that all issues and questions concerning the construction, validity, interpretation, administration, and enforceability of the Initiative Rules, or the rights and obligations of an subscriber and Sega shall be governed by and construed exclusively in accordance with the laws of the state of California without giving effect to any principles of conflicts of law of any jurisdiction and that: (a) any and all disputes, claims, and causes of actions arising out of, or connected with the Initiative, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating, but in no event attorney’s fees; (c) under no circumstances will any subscriber be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. By entering the Initiative, all subscribers agree to be subject to jurisdiction in the Federal and State courts of California and agree that all disputes relating in any way to this Initiative must be resolved in the courts of California. Entrants agree not to raise the defense of forum non convenience.
